Terms of Service

By using The Bellweather Project website at bellweather.blog or the Tuner app, you agree to these Terms. If you do not agree, please do not use them. Stratis, Inc. operates and publishes both. The Bellweather Project website documents an ongoing investigation into the Resonance Points first identified by Maren Calloway; the Tuner app is the companion mobile app.

You can use The Bellweather Project website and the Tuner app in different ways. You can read the investigation, solve puzzles, participate in discussions and theories, and use other non-capture features without creating captures. If you choose to use the Tuner app to record a nearby Resonance Point, the capture-specific terms below apply.

1. Eligibility

You must be at least 13 years old to use The Bellweather Project website or the Tuner app. If you are under 18, a parent or legal guardian must read and agree to these Terms (including the capture terms below) on your behalf and is responsible for your use of the website or app. We do not allow anyone under 13 to use the website or app.

2. Your account

You are responsible for what happens on your account. Choose a strong password, do not share it, and let us know promptly if you suspect unauthorized access by emailing support@stratis.ai. We may suspend or terminate accounts that violate these Terms.

3. Acceptable use

When you use the website or app, you agree not to:

  • Trespass on private property, ignore posted signs, or enter restricted areas to reach a Resonance Point. Resonance Points are placed at publicly accessible locations; if a point appears in a place you cannot safely or lawfully access, skip it and report it.
  • Harass, threaten, or dox other users; post hate speech; or impersonate other people.
  • Submit false echo reports, manipulate captures, or otherwise attempt to misrepresent your activity.
  • Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law.
  • Use the app or website to violate any law or any third party's rights.

4. Real-world safety

The Tuner app is an augmented-reality app that can ask you to walk in physical space and point your phone's camera at the world. Use common sense. Do not use the app while driving or operating machinery. Watch your surroundings. Be aware of traffic, terrain, weather, and people around you. You are responsible for your own safety. Stratis is not responsible for injuries, property damage, or other losses you sustain while using the app.

5. Your content and captures

Non-capture content. You retain ownership of the non-capture content you post, such as echo submissions, comments, discussion posts, replies, and profile material. By posting non-capture content, you grant Stratis a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and create derivative works of that content for the purpose of operating and promoting The Bellweather Project website and the Tuner app. You can revoke this non-capture content license by deleting your content; we will remove it from active display, though copies may remain in backups for a limited period. You represent that you have the rights to post what you post and that it does not infringe anyone else's rights or violate any law.

Captures are optional and different. You do not have to create captures to use The Bellweather Project website or the Tuner app. Before recording begins, the Tuner app presents an in-app acknowledgement and gives you the choice not to proceed. If you choose to proceed, the app may request camera and precise-location access so you can create a "capture": camera recordings and 3D / AR spatial scans of real-world places, together with the precise location where you made them.

You own your captures; you grant us the rights needed to operate the map. You keep ownership of your captures and the scan-derived assets created from them. By choosing to proceed after the in-app acknowledgement and creating or submitting a capture through the Tuner app, you grant Stratis, Inc., its affiliates, and its permitted processors (including Stratis ECKO Miner nodes, which may be located anywhere in the world) a worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, modify, combine with other data, create derivative works from, publicly display and distribute, and otherwise use your capture and data derived from it to operate, build, maintain, and improve the spatial map and related products and services, including to train, develop, and improve machine-learning and AI models.

Capture use settings apply going forward. Scan-derived assets and capture use settings are managed through the Stratis App or in your Stratis account at stratis.ai. Those settings can limit future use of your captures and let you delete scan-derived assets that are still available for deletion. They do not terminate or limit rights already granted for processing already in progress, completed processing, derived work already created, public map or community features, trained models, completed miner jobs, blockchain records, or records we must keep for legal, accounting, fraud-prevention, or security reasons.

Some capture rights survive changes, deletion, and termination. Except where your capture use settings limit future uses, the capture license above is perpetual and irrevocable for: (a) any capture or capture-derived data that has already been processed, displayed, distributed, combined, or included in the spatial map or related features; (b) anything already built from or trained on a capture, including the spatial map, scenes, layers, Gaussian splats, and machine-learning or AI models; (c) completed or in-progress ECKO Miner jobs; (d) blockchain records; and (e) legal, accounting, fraud-prevention, or security records we are required to keep.

Your responsibilities for captures. You alone decide whether and where to create captures. Do not intentionally capture your home, where you live, the inside of any private residence, private property you do not own or have clear permission to capture, identifiable people, faces, license plates, other people's personal information, or sensitive places such as where someone lives, works, worships, receives medical care, or takes shelter. Do not use the Tuner app to capture, follow, monitor, harass, or surveil any person, or to make an identifiable person the subject of a capture.

Your warranties each time you create or submit a capture. Each time you create or submit a capture, you represent and warrant that: (a) you have all rights needed to record that place and grant the license above; (b) the capture is safe, lawful, and appropriate for the project; (c) the capture and its use do not violate any person's privacy, publicity, intellectual-property, property, or other rights, or any law; and (d) the capture and its use do not create a safety, security, confidentiality, or legal risk for you, Stratis, or anyone else.

You are responsible; you indemnify us. You are solely responsible for your captures and the places you choose to capture. You agree to indemnify, defend, and hold harmless Stratis, Inc. and its affiliates, officers, and employees from any claim, demand, loss, damage, or cost (including reasonable legal fees) arising out of or relating to your captures, your breach of the warranties above, or your violation of anyone's rights or any law in connection with a capture.

6. Our content

The Bellweather Project website and the Tuner app, including the blog posts, the Resonance Point system, the Echo content, the audio, and the visual design, are the property of Stratis, Inc. and its licensors. You may read, share, and discuss the project freely; you may not republish substantial portions of it elsewhere or use it commercially without permission.

7. Moderation

We may review, edit, or remove any content posted to the project for any reason including violations of these Terms. We may suspend or terminate access to the project for users who repeatedly violate these Terms.

8. Information and advice

Material published through The Bellweather Project website and the Tuner app, including blog posts, audio recordings, archival material, and content surfaced via the app, is provided for general informational purposes. It is not professional advice (medical, legal, scientific, psychological, or otherwise) and should not be relied upon as such. If a topic discussed here intersects with a decision in your own life, talk to a qualified professional.

9. Disclaimers

The project is provided "as is." We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that the project will be uninterrupted, error-free, or always available.

10. Limitation of liability

To the maximum extent permitted by law, Stratis and its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the project.

11. Termination

You may stop using the project and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination, including ownership, content and capture licenses, capture-derived rights, warranties, indemnity, disclaimers, liability limits, and governing law, will survive.

12. Governing law

These Terms are governed by the laws of the United States and the state in which Stratis, Inc. is principally located, without regard to conflict-of-laws principles. Any dispute arising under or relating to these Terms will be brought exclusively in the state or federal courts of competent jurisdiction in that state.

13. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will update the effective date at the top and, where appropriate, notify you in the app or via email. Your continued use after an update constitutes acceptance of the updated Terms.
